The lead agency for this proposal has determined that, as conditioned, it does not have a probable significant adverse impact on the environment. Pursuant to WAC 197-11-350(3), the proposal has been conditioned to include necessary mitigation measures to avoid, minimize, or compensate for probable significant impacts. An Environmental Impact Statement (EIS) is not required under RCW 43.21C.030(2)(c). The necessary mitigation measures are listed below. This decision was made after review of a completed environmental checklist, other information on file with the lead agency, and comments received on the preliminary mitigated determination of non-significance (MDNS). This information is available to the public on request.
Determination: This final MDNS is issued pursuant to WAC 197-11-340(2); pursuant to WAC 197-11-340(2)(f) a preliminary MDNS was issued on July 7, 2023, with a 14-day comment period. The City has reviewed all responsive comments received during the 14-day comment period and is retaining the previously issued preliminary MDNS as its final MDNS. The lead agency will not act on this proposal for 14 days from the date of issuance indicated below.
Comment Period: This MDNS is issued under WAC 197-11-350 and WAC 197-11-340(2). A previous 14-day public comment period has been completed. There is no comment period on this final MDNS.
Appeal: An appeal of this determination may be submitted to the City of Spokane Valley Economic Development Department at 10210 E Sprague Ave, Spokane Valley, within fourteen (14) calendar days of the date of issuance indicated below. Appeals must be received by the City no later than 4:00 p.m. on August 18th. Appeals must conform to and shall be conducted consistent with Spokane Valley Municipal Code (SVMC) 17.90 Appeals, and other applicable SEPA statues and regulations, including as set forth in WAC 197-11-680. Any required fees pursuant to the City’s adopted fee schedule shall be paid at the time of appeal submittal.

Mitigation Measures:
(1) Automatic residential sprinkler systems shall be installed in all new homes per the International Residential Code (IRC);
(2) A minimum of a 30-foot green space shall be constructed around all new homes to buffer from threat of fire;
(3) All buildings and structures shall be constructed in accordance with the Wildland-Urban Interface code Class 3 Ignition-Resistant construction; and
(4) A 5-foot-wide asphalt pedestrian pathway shall be constructed on the south side of 44th Avenue from Farr Road to Woodruff Road. The pathway shall be consistent with the following:
The pathway shall be offset at least 5 feet from the existing asphalt edge on 44th Avenue where possible, subject to accommodation of drainage and construction of the pathway within the existing right-of-way.
